CONTRACTUAL TERMS


I. Object of the draw:

1. To be drawn is the residence Villa in Nice, South France

2. The presently recorded mortgage will be cleared simultaneously with the transfer of property to the winner in the register. The property will be transferred free and clear of any encumbrances.

II. Notary:

1. The draw will take place in Cyprus under the supervision of a Notary. The property transfer according to the registration of the winner will be executed by Notary in Nice.

2. The proceeds from the sale of the lots will be credited on the escrow account.

III. Contractual terms:

1. Both natural persons and corporate bodies are admitted. Natural persons have to be of legal age at the time of the draw (being 18 years old) and legally responsible.

2. The participation in the drawing is exclusively possible through the web site provided by the owners Family Matejlan. The legally binding personal information to be provided at the time of purchase of the drafts includes last name, given name, country and e-mail address as well as the number of drafts required.

3. The participant is responsible for the correctness of the personal, bank data provided.

4. For each lot purchase there will be a lot number attributed. After the completed draw, the notary will be able to establish the winner based on this information.


V. Payment by bank wire

1. Payments are only possible using a previously made registration, with the selected option "bank wire". With this registration you will have secured the number of requested draws for 14 days.

2. When sending a bank wire, the field "Concept" should include the name of the registered buyer/beneficiary and his e-mail address.

3. The lot becomes effective with the credit of the amount correspondent to the number of purchased lots on the above mentioned bank account. Example: number of purchased lots: 2 lots - credited amount 50,- €.

4. One and the same participant can register himself repeatedly for a lot purchase per bank wire.

5. Incoming payments of less than 25,- €, respectively amounts not corresponding to a full lot price will not be returned.

6. After receipt of the payment on the escrow account, you will receive the lot numbers per e-mail.


VI. Number of lots

1. 49.999 lots will be sold, whereby participants may purchase any number of lots.


VII. Lot number allocation

1. The allocation of the lot numbers occurs randomly, i.e. a number from 00001 to 49999. Therefore there will be a 5-digit number issued for every lot purchased. The amounts paid in are credited on a specific escrow account held and administered by the notary who will allocate the lot numbers in a list.


VIII. Lot price

1. The price for 1 tickets is € 25,- Euro

IX. Term of the draw

1. The public draw will take place from the 11.2010. When all tickets are sold. The exact date and location of the raffle will be published.


X. Cancellation
If by the end of November 2010 are not all lots sold, the raffle lengthen for 3 months. And the draw date is shifted in time accordingly.

In case of cancellation the paid in amounts will be returned. This would be accomplished by means of a e-mail form, to be sent out to all participants, stating the IBAN+BIC where the amount will be credited.

XI. Draw of the lots

1. The draw of the 5 digit lot number will be performed following this procedure: numbers will be placed in identical non-transparent spherical receptacles in 4 equal translucid bins. The first bin will hold the receptacles with the numbers 00-49 and the other 3 bins will each hold receptacles with the numbers 0-9. From the bin holding the double digit numbers will be drawn the first draw setting the 10'000 and 1'000 digit, subsequently from the other 3 bins will be drawn the 100 digit and the 10 digit. In the last draw, in case the preceding draws where all the number(s) 00 respectively 0, the number 0 should be removed from the bin.


XII. Winner information

1. After the draw is completed, the winner will be established based on the list of the lot numbers.

2. The winner ticket nummber will be published.

3. The winner will be contacted by the notary based on the e-mail address provided and telephone.

4. Moreover the winner respectively his legal successor in interest will have a 20 day term, counting from the day following the draft, to accept the price. Should the notification procedure by the notary fail i.e. the winner fail to contact the notary, a new draw will take place within 3 working days.


XIII. Handover of the draw price

1. Within 14 working days after the winner contacted the notary, he will draft a legal document with the seller and buyer to allow the winner to record the deed at the cadastral register.

2. The winner will have the opportunity to visit the property before accepting the raffle.

3. The handover of the draw price is done without guarantee for a specific condition, a specific earning capacity, a specific size, location or constitution. The date of the certified signature of the property deed will be the effective date for the handover to the winner with the correspondent transfer of rights, obligations and risks. The present owners oblige themselves to sign the deed without any delay.


XIV. Costs and fees

1. All duties, costs and other tributes in relation with the draw and the transfer of ownership will be carried by the present owners.


XV. Protection of data privacy

1. The registration and the settlement are carried out applying the current technologies over secure data links. All data from the participants will be protected according to the statutory regulations of data protection and will be deleted from the data processing equipment after the property transfer takes place.


XVI. Other clauses

1. Viewing dates for the property will be published in the home page; viewings outside of these dates is not possible.
